Hi I need a small clarification, if a person who is holding H1 stamped visa with company X , is it legal for them to file new H1 thru company Y and enter US or can he do H1 transfer as the person is back in home country and never been to US.
---------------------- Mr ABC has valid H1 stamp through company X on his passport.person is out of US. company B can file new H1 once H1 approved get new H1 stamp with new company name and enter US. H1 transfer can be filed only if H1 holder in US on valid H1 STATUS and if the person has valid I-94 AND latest 2-3 pay stubs from prevous company
