Hi I need a small clarification, if a person who is holding H1 stamped visa with company X , is it legal for them to file new H1 thru company Y and enter US or can he do H1 transfer as the person is back in home country and never been to US.

If you have an h1 and visa stamped in your passport and you never entered into US, then you can not change your H1 to any other company.
