H-4 extension I-539 filed.......but

Hi All,

I would like to keep it simple so that everyone can understand my case here

theres a lot of issues, but the core issue here is last name first name issue.

Im on H-1 B, my wife on H-4.
my labor was approved on may 26th 2008. now im applying for I-140, I-485 , ead, Ap

my wifes h-4 was about to expire in sep 08 and before I filed 140, 485 & other stuff I filed for H-4 extension just to be safe

lets say my wifes name is Jane Alice Doe

The way it appears on her passport and H-4 stamp is given name: Doe

surname : jane alice

Now while filing H-4 extension I used first name: jane Middle initial : A, last name: doe

now im using the same format for 485 ead etc,

i wanna know if that poses a problem.

Now im thinking if I-539 is approved without any hiccups, then I wont have any problems during 485 etc.
I-539 is already filed & we recieved a notice of action. is there a way to change this current application to premium processing so that the processing is fast.

Any thoughts!!!!

This should not be a problem. You have defense on your side to show that to the best of your knowledge, you interpreted your spouse's name appropriately and substantiated your interpretation by attaching required evidence (copies of passport pages). USCIS is not known for slapping people with these kind of technical errors, even if it is discovered as an error in future.
