H-2A visa
USCIS changed some regulations in Jan 2009. They have now a country list and nationals of countries that are not on this list cannot apply for this visa any more.
But they seem to have a couple of exceptions like if the worker already had an H-2A visa before - which is the case in this instance.
Nevertheless they want proof that no worker can be found in the US or any of the listed countries. Now, we sure have problems to advertise in Zimbabwe, Ukraine and such and therefore have a hard time finding a proof.
Does anybody know if a national from a country NOT on this list has any chance to obtain this visa?
We are trying to get our livestock worker from Austria back - never had a better seasonal worker!
