GINNU and others please help. this has been anwered in the forum, but want to get your opinion
My situation is that I Had been working for the GC sponsoring Employer (We call it as Company A) for 8 months from Apr(2001-December 2001).They had applied for Labour Certification during Sep 2001 and got the approval in Jan 2002. I had quit Company A before I-140 was applied and joined Company B.
Company A was kind enough and had applied for my I-140 in Feb 2002 and the approval of I 140 came in Feb 2003, and applied my I-485 for the future job in end of Feb 2003.
Company B has applied for Labor certificatin during end of Jan 2003.
My 6 year H1 is getting over in Feb 2004,Company B wants to file for Extension of H1B for the Seventh Year.
Can I use the provisions of AC21 to change the GC sponsoring Employer as the present employer Company B using AC21 ?
What are documents required to present AC21 ?.
Is my case complicated as I have not worked for the GC sponsoring employer (Company A)since filing of I-140 and been working for Company B .
The job functionalities in both the companys are almost of the same nature.
What are the questions might be asked in the interview?
