FYI: H1-B Cap for Fiscal Year 2004

The United States Citizenship and Immigration Services (USCIS) is expected to announce shortly that it has received enough petitions to fill the annual cap of 65,000 H-1B visas for Fiscal Year 2004 (October 2003-September 2004). Once this announcement is made, no more cap subject cases will be accepted for this fiscal year. It is expected that USCIS will stop accepting cap cases under premium processing even sooner.

USCIS will officially make these announcements through Federal Register notices later this month or in early January.

Note that individuals who already have H-1 status, who have extensions pending with USCIS, or who will file H-1 extensions are NOT impacted by the H-1 cap. Only those who are applying for first time H-1 status are impacted and must take action now to initiate the H process.
