Do you guys think I should file another I-140?
My I-140 for NIW was approved in June, 2005 and the priority date (PD) is April 1, 2005. I filed my I-485 in August 2, 2005. I am from China. The cut off date for China EB2 in the August Bulletin is March 1, 2005. However, there is no progress from July to August and it looks like that it would retrogress back. Who knows how long it will take to pass my PD of April 1, 2005, although the current off date is March 1, 2005. Since China EB1 is current now, I was wondering whether I can file an EB1 I-140 by myself now. Just to try.
The bottom line is: do you think it is worth to try? If I get my EB1 I-140 approval, I understand that I am supposed to tie this I-140 to my filed I-485. Then what's my PD? Both NIW filing date and EB1 filing date can be PD? Or I can only keep one PD? If so, which one is my valid PD?
