Employer not paying Urgent Help!

Hi Guys,
I am on H1B currently on project.
I have a vendor company in between my company and the clients.
My employer pays me after 2months... like July salary I get in October. I am going back to India for good in November, I wanted him to pay me my full salary, he said the Vendor company pays them with 1 month delay and vendor says this is a cyclic delay.
Is there any thing I can do about this legally?
Also, if I go back to India and the company doesn't pay me anything, in that situation, are there any legal steps I can take to get my salary back.
Please I really need help with this... Please help me ASAP....

You may file with the DOL if they fail to pay you the wages due to you. Unfortunately, you did not complain earlier. You may have signed a contract agreeing to the payment delay. It is obvious that your employer was not well funded or he would have had adequate funds to pay you in a more timely manner.
