EAD on HOLD

Applied for my 2nd EAD on June 24th and still waiting. Today went to the local office for IEAD but the officer told as the EAD is on hold ...they can't issue the IEAD....don't know what to do...please through some light if some one had the similar experience.

my 2nd ead didnt approved?
please shed some light, i dont have H1 and now i am in 8th year

Did they tell you the reasons for hold.? I see in some other forms that some employees of cybersoftec have similar issuue!
 
Can you let us know why they didnt issue IEAD?
its very important to us, it will help us a lot

Toady morning when i went to the local office for IEAD they checked their computer with my EAC number and just told me that the EAD application is on hold and so they can't issue an IEAD.

Thanks for info, when i called to Pretigeous attorney and i paid 200 dollars for consultation, they told me clearly that Iead , uscis will provide you eventhough your company is in bad shape or had lot of RFE's
USCIS will provide IEAD irrespective of company it seems as per that attorney

my case is vey bad then, i have only 9/215 and i have to get orelse its tough, as i am in 8th year and working on ead and i dont have H1

I have applied for my EAD renewal on May 2005 and after 90 days I went to the Local office that they said the same reason as yours.

My current one expires in a week. I have no idea what to do...God only knows as always.

do you guys applied thru Cybersoftec becoz i think only those guys are getting this kind of info when they went to Local INS for interim EADs

That is exactly iEAD is for. So one can continue to work with iEAD when the real EAD is on 'hold'. If you showed up to the local office after 90 days of filing EAD, they have to give you iEAD. If they don't, demand to speak to the supervisor. The officers don't know all the rules. Some are new recruits and poorly trained. BE POLITE, BUT ASK TO SEE THEIR SUPERVISOR. You paid for EAD, didn't you? They have to ADJUDICATE it one way or the other (approve/deny). This is the premise for the argument.

By the way, which local office is it?

Earlier I was with this company, and then I have used AC21 and applied EAD renewal through different company
 
My experience

Hello all: I have this question for you if could help me.

I applied for AOS (I sent I-485, I-864, I-765, I-130 to Chicago lockbox)based on Marriage to USC. My timeline is as follows:

RD: April 29th, 2005
ND: May 25th, 2005
FP/Biometrics: June'25th, 2005
RFE for Medical: July '16th
Medical Submitted/Received: August 16th, 2005
I-485 LUD: August, 29th, 2005


But NO EAD yet :mad: !! I talked to CSC Hotline many times about my I-765 and they said after 90 days you can go to DO and get a Interim one. On Sept, 6th, way past 90 days from ND, I went to Detroit DO to get an Interim one because I have job lined up for a presitigious IT consulting company. But they refused to give me interim because apparently when I did my FP, I was supposed to tell the ASC people that I have applied for I-765 also and they will send the FP file to I-765 adjudication as well as for I-485. And the immigration officer said, "Maybe, that is why your I-765 is on hold." And apparently he didn't know on what ground I was seeking EAD because he asked me, "Are you doing your AOS on LIFE act, Legalization?" I said, "No sir, I am doing on the basis on my wife being a USC." Then he sort of fiddled with the computer and said, "Your I-765 application has C29 code , it should be c4 etc etc " which by the way I didn't fully realize what it was about. BTW, at the time FP/Bio I took ALL my receipts with me but they only stamped on my I-485 receipt and NOT on my I-765 receipt. Oh!, then the DO officer told me, " Go back to ASC and tell them to send your FP for I-765 also". When I asked, "Can I just walk in or do I have to make an appointment?" he sort of raised his shoulder.."Yes, Yes..just call hmmm"..He didn't even know what he wanted me to do, can you believe it?? Then he said, "Your application (which one?? :confused: ) is on hold since August 23rd and you have to call the hotline to see why?"

Well, then I left.

I came back and called USCIS hotline and talked to a Immigration officer on the phone and asked her, "Can you tell me what DO officer was talking about and why i can't get my interim EAD?" She said, "I don't know why he referrerd you to us, they at the DO have much more information than we do here". And then she explained about RFE and how that reset the ND for EAD. She couldn't clarify what or why or which of my appliation is on hold. When I asked "Is my application complete now?" She said, "As of August 16th, your I-485 application is complete".

Oh..BTW: LUD on my I-765 is Sept'06,2005, the day I went for interim EAD.

My question is : Is it true you have to go for two FP/Bio for I-485 and I-765?? Isn't it supposed to be one FP for both of those applications? Then why DO officer (and honestly he didn't seemed to know what was wrong either, he sort of looked apologetic (from his body language) when he declined to give me interim EAD!!) asked me to go back to ASC and tell them to resubmit my same FP/Bio for I-765? D

Do you have any experience about these sort of things? what is going on?

Be polite and ask their supervisor? They may just deport you right then and there. No, in all seriousness, USCiS can at any time put a hold on any application. Local office has no authority what so ever on lifting a hold on an EAD if the service center has put a hold on it.

Doubt if talking to the supervisor or asking for iEAD after 90days of application will be considered grounds for deportation.
 
Delayed Ead Renewal Un,joyd,eta-gc,jharkandi, joyd

Afriend filed I-140, 765/485/131 for self and spouse in 08/04. EAD,AP were approved in 14 days. Now EAD/AP expired and the 2nd EAD was not submitted until this august and is not approved. The 140/485 is not approved completed FP and already submitted VisaScreen EB 3 schedule A.
The company has not raised any issue with the EAD, what is the risk of continuing to work prior to 2nd EAD approval.
He was in good F1 standing with I-120 set to expire in june 2006, but has not been in school since commencing work with EAD.The attorney feels 140/485 will be approved concurrently as there has been no RFE and VSC has already passed PD 08/04 and not affected by retrogression
Spouse is not working hence will need to support the family.
Please UN,JOYD,ETA,JHARKANDI and LC your comments and advice would be most appreciated

Hello Marathan,
i am currently an employee of this stupid Cy... company. My i-140 is approved and 485 has been pending for more than months now. this company has a RFE looking at all cases. if I use AC21, will it affect anything ? in the last stage , before getting GC will INS say that your previous employer was cy....., hence GC denied ? how does AC21 work ?

are you also affected by this RFE ???

Hi Mad526,

You are eligible to use AC21 now, the RFE might affect your case, but for the safer side you better wait and use AC21.(Depends upon your EAD duration you can decide, That means if you have 10 more months of EAD validity and that stupid company(CS) sent the RFE already, you can now switch the company)

The Advantage:
Your new company attorney will fight for you if there is any problem...

I have used AC21 long time back, but because of this stupid CS fraud, My EAD renewal is on hold.
