I brought my wife over here from the phillipines on an K-1 Visa in 03-04-07
We have been married for till now, I've filed divorce in taking sole custody of my 1 month old baby boy.
She and I have been having problems since the begining, it always has big time abuse from her and then we work it out, then abuse from then work it out over and over again.
Little over 9 months ago we decided to have a baby, let alone after we went for it, she was pregnant, she then was straight forward in a very abusive matter. Never nor less I feel that she did that, incase I did divorce her in thinking it would be her Anchor baby.
At this point, I just want to end this, claim my son. she does have her I-485, but she cannot take care of our son. What rights does she have to counter claim the divorce? so far i've filed sole sole custody, and she answered with a counterclaim for divorce with saying that I have joint custody and that I have to pay child support?
