Current Employer doesn't want to extend H1B , Wants me to use EAD

Hi,

I have got EAD and My I140 was cleared in 2008. I am in EB2 India.

My employer paralegal is saying that they will no more extend my H1 (already used 6 years) and i will have to Use EAD ( which i am maintaining at my Cost)

Please let me know the benefits and if there's something i need to make sure before i go for EAD.

You only needed to maintain the valid nonimmigrant status up until time of filing the I-485. To continue the H1-B is a waste of money and effort. If the I-485 is denied, you will fall out of status and be told to depart the U.S. How likely is that to happen? Not likely if you got the H1-B and extensions UNLESS it was all based on fraud. If that is not an issue then, you have nothing to worry about. If it has all been based on fraud, then you should be denied and kicked out. Again, that's not an issue, right? Why worry?
