Could you please evaluate my situation? Thank you all

Hi everyone,

I applied in EB1-OR category more than a year ago without PhD degree. I had less papers and citations compared to what I have now. I also had 6 ref letters. At that time INS sent me an RFE. They were questioning one of the ref letters which was not strong enough and they also wanted me to show that my work was internationally recognized. Then we withdraw the application and decided to reapply again.

My first 3 year in H1 will be expiring soon. I applied for an extension several months ago.

Now I am planning to reapply in EB1-OR or EB1-EA category
Here are my qualifications:

1. PhD In Electrical Engineering from a US university ( just graduated)

2. I worked full time as a research specialist since 1999 (H1-B). Prior to that I worked as Biomedical Engineer for a short time(Practical training). My research is in Biomedical field especially in Cardiovascular research. Working on the development of the medical devices who can prevent some cardiac problems

3. My position will soon change to Research Associate. I think Research associate is better research specialist. Am I right?

4. 6 journal papers (mostly 2nd author)
1 journal paper just submitted ( first author)
6 conference papers ( first author in 2)
20 abstracts presented in various conferences

5. 2 US patents

6. 14 citations

7. I can get about 10 or more reference letters

Your experience and feedback is very important. Please share your opinion and experience. What do you think about my case? What are my chances? Any suggestions?

You are a newly graduate; specialist is a kind of technician; associate is so so.

You can definitely try, but not so strong a case, as it was indicated.

Acturally you do not need to wait; use your 3 years of H1 to fulfil the 3 years of requirement for OR; stress your research and patent significance rather than your titles, especially the older one. The best is to go with OR since EA is more difficult. The reference letters are crucial for your case.

what would make a strong case?

I have 3 years left in my H1-B. Do you think it will be better for me wait for sometime and then apply again since I just graduated.


What would make a strong case? Do you have any experience?

I have applied for EB-1 OR thru my company, with all the usual qualifications (PhD + 2 yrs exp, 8 journal papers, 10 conf, 2 patents, 5 strong references, couple of journal reviewing, some citations, couple awards)

Lets see what happens
