Consumed 485 numbers - Fiscal Year 2010

There isn't much demand from other countries in EB1 and EB2 other than India, China, Mexico and Philippines. So in order to consume all 40040 visa each in EB1 and EB2 categories, India and China received more than the allotted 2803 (7% of 40040). Besides, unused numbers from EB4 and EB5 fall back up to EB1 where demand being less ultimately fall back down to EB2. EB2 has high demand itself and that prevented any visa to go unused and hence further fall back down onto EB3. In essence, EB2 (for India & China) was benefitted by both Vertical shift (accross preference categories) and lateral shift (within category), while EB1 (for India & China) was benefitted mostly by lateral shift of visa within that category.

EB3, unfortunately for India didn't get any help from lateral nor vertical shifts because the demand from all 'other' countries were sufficient to consume all 40040 visas. Come 2013, and you might see this number jump for India a bit but not until then, unless there is some infusion of more Visa numbers by the congress or unless there is some change of some of it's current laws.
 
thanks for the explanation. I thought they waste the numbers and do not allocate more than 7% per country per category strictly.
hope they allow equal overflow into EB3 and EB2 soon. Soon family based 3rd and 4th category will beat EB3.
