Hi, my case is kind of complicated, looking for some advice.
I am actually working in the US with an H1B that expires 12/21/2018. I am of Honduran nationality. My wife is under H4 status, Jordanian nationality. Me, Jewish. My wife, catholic.
My wife’s father is a US citizen since 2006. In 2007 he put in a request for all his daughters and wife... all have received green card except my wife because she was already over 21 and married. We have a US citizen son. Our filing date for her case (f3) is June 28, 2007. Actual priority date I believe is Dec 22, 2005. We still have a couple more years to wait.
We can’t go to Honduras to live because of the political situation of the country. Even the US Department of State has recommended its citizens not to visit Honduras lately. We can’t go back to Jordan because of religious reasons.
Can we apply for asylum and wait for her case resolution in the US?
Can I continue with my job even after my H1B has expired once we apply for asylum?
Would it be better for me to be the applicant or for my wife to be the main applicant?
Starting to get desperate...
