Changing company 11 months prior to H1B visa expiration

Hello,

I started on H1B visa on sep 2007 with my current company. It expired in sep 2010 which was then renewed. Now its again due to expire in sep 2013. My current company has filed for my LC Perm and GC under EB-3 Category. I have received I-140 approval. If I change my company now, I assume the new company would have to file for my LC Perm and GC immediately. However, I want to make sure it is a safe transition (immigration-wise) considering that my second H1B will expire in sep 2013. What amount of GC processing should have completed prior to sep 2013 for me to be able to legally stay in the US and work with the new company? Is it sufficient to have applied for the LC Perm or should I have gotten at least the I-140 acceptance before sep 2013. Please advise.
