Can someone(Who is aboard) use a pre_approved LC to file I-140

and at the same time apply for H-1B for a different Job from the same Co.?
Will USCIS figure this out? Would it be an issue to apply for one position of H-1B and another position of LC?
Would H-1B visa get denied beacuse of using LC in different position?
