Can I be on TD (TN Dependent) visa, while being on Maternity leave & employed with a Canadian firm?

Hi,

I am currently on Maternity leave, employed with a Canadian firm. I receive my maternity paycheck in my Canadian bank account. My spouse moved to the US on a TN visa, and I decided to join him on a B2 visitor visa, which expires in May. Should I change my status to TD or apply for a B2 extension?

Does a TD visa prohibit me from being on any sort of employment outside of the US, even if I am not actually working and I am currently on maternity leave? Also, my maternity paycheck remains in my Canadian account, and is not brought into the US, does this have any impact?

You aren't working. You're getting insurance benefits. Simpler to get TD, since you probably don't have a home in Canada anymore (which is a requirement for B2) and it lasts the length of TN.

Btw, despite what people think, where the money goes or comes from has nothing to do with whether work is allowed or not.
