Birth Certificate substitute.

I am on the verge of filling I-140, Unfortunately, I don't have my Birth Certificate, In India they accept School Leaving Certificate / Passport instead , so never felt of getting the duplicate one.

But, now My lawyer said that you can get affidavit from your parents and get it notarized it will work fine. But just from my side I want to check whether any of you did this before.

Please advice.

birth cert goes with I-485 not with I-140 - unless you are filing concurrent. Affidavit is not from the parents but two people about your parents age (get more details from a reliable lawyer); if the birth was never recorded -you may also need a letter from the hospital / clinic that you were born in, stating that the births the year you were born were not recorded. Also before you file concurrent make sure you are aware of the change in portability law as well as what I hear that the I-140 will not be adjudicated until the time of I-485 adjudication.
