B-2 to H-1 Conversion while in U.S.
My uncle is in the United States on a visitor's visa. He wants to convert that into a H1 (H-2) visa and work here for a couple of years. He is 58 years old and had worked as a lecturer in Chemistry for more than 28 years in India. He now has a couple of job offers here but they are not related to his prior experience/field. Both of them are managerial positions in some local businesses.
What are his chances for getting a H-1 visa conversion approved ? What happens to his 10-year multiple entry visitor's visa once he applies for H-1 ? Can he still stay in the country in his visitor's visa even after the H-1 application is filed with the INS ?
