Attending Part-time graduate school while on H1

Hello:

I work in California and am on my 3rd year of H1. i plan to attend graduate school part time while I keep my current job. Now the questions I have are:

1) Can i attend school part-time while on H1B visa staus?
2) Would I have to forego my H1B and take up an F1 status to attend part-time school?
3) If answer to #2 is yes, then can i work with my current employer? and final question is:
4) Will I able to visit India during the time I am a part-time student cum employee on H1B?

Hi Karthik,
As far I know, people have done this (attend class at night/evening) but I am not sure if there are any legal issues with this. If your employer is ok with taking classes and you can manage both working and taking classes, you can do it. There is no need to change to F-1 unless the program you are trying to attend have specific requirements. I would ask a lawyer for advice.
