My wife is in the US on a H4 visa. I am on the related H1B.
She recently applied for a job at a 501(c)(3) nonprofit organization.
And after a few interviews she received a negative answer. The organization is saying that due to her visa situation she would only be able to work for them in October 2013.
It was my understanding that 501(c)(3) nonprofit organizations were not subject to H1B visa cap.
And therefore could sponsor someone at any time.
Does it seem that the organization may have the wrong information?
Or are there other conditions that the organization must meet in order to be exempt from H1B visa quotas?
