Hi,

What I need to send...?

For my Wife
1. I765 form
2. Check
3. Both side copy of old EAD
4. I485 Receipt.
5. Two photos.
6. Current status approval notice
7. Marriage Certificate

For Me
1. I765 form
2. Check
3. Both side copy of old EAD
4. I485 Receipt.
5. Two photos.
6. Current status approval notice

Do I need to send the copy of I94? Since she is already in India
I don't have the I94 with me. And since I don't have a I94 for her
I don't want send for myself also.

Is this going to be a problem if I apply now for her since she is in India and coming back on 27th Feb'04. Also I will be going to india on 9th Feb'04 and coming back with them.

Can I send both of our applications in the same envelope?

In the I765 form, there is a date column where they asked for if I have applied for EAD earlier or not, if it is granted or denied....
What date I will put in there, approved date or apply date of my old EAD?

Any help will be greatly appriciated.

Thanks in advance.

Unbelievable:(

No, you do not need I94. You do not even need back of old EAD, just the front.
The date you can put is the start date of the period mentioned on your old EAD. That's what I did for my renewal, as per my lawyer's instructions.

Goober

It is better send all the previous EAD copies( if it is # EAD) , i will strong argue on this point . Hope this will click for 485 approval.

good luck..

Guys, please do not give wrong information, if you are not sure.

On EAD application instructions, it says...

'If you are mailing your application to the INS, you must also
submit:

A copy of Form I-94 Departure Record (front and back), if
available.

A copy of your last EAD (front and back).

2 photos ....
'

You need to add mailer from last approved EAD. I think it is I-765D. Also I-140 approval notice. After con-current filing They are generating RFE for this.

This attachment i used to apply EAD. I got it from CSC forum.

Thank God, before mailing our EAD renewal applications I re-cheked the forum. Thanks ar888.

For I-94, I have a problem. I have I-94 but my wife already left USA and they are now in India. So at airport they took the I-94 but I have a copy of it.

Now, is this going to be a problem, hence my wife is india how can she is applying with a I-94 copy? Actually I am applying for both of us.

Any quick help is greatly appreciated.

Unbelievable.

This list from lawyer

Hi Unbelievable
I got this list from my lawyer today morning.

2 immigration photographs
filing fee of $120 payable to USCIS
copy of I-485 receipt notice
copy of current EAD
copy of marriage certificate
Form G-28
Form I-765

So I guess I-94 has not been asked for by them. I also do not remember sending that the previous time i did the renewal.
Hope this helps.

The instructions say 'Send a copy of Form I-94 Departure Record (front and back), if available'. Send all the other required documents mentioned by ag28 and tammy2.

Send the applications in different envelopes but make sure you get the certified mail and return receipt from them just in case...

G-28 is sent by your attorney, if he represnts you. You don't need it, when you are applying on your own.
