I got married in India recently , but my wife will not be able to join me in US until june 2003. I am in H1B now and also filed my I140 this Oct 2002. My H1 6 yrs expires sept 2003 . Is it possible for me to file I485 for her when she is in India or Can i don only CP. My lawyer says we cannot unless she comes here. The disadvantage in CP is that I cannot do concurrent filling until my I140 is approved. Also is I do CP and my visa expires I will have to return back. If I want to do CP for her and 485 for me then I was told that until my 485 is approved, her CP cannot be filled. So please advice me.
