I was sponsored by my U.S. citizen brother. I waited about 12 years to immigrate on the basis of the brother’s petition. By the time I was able to immigrate, my daughter had "aged out" (the consulate calculated that the age of daughter is 21 years and a couple of months with CSPA) and so was unable to accompany me to the U.S. Can my daughter immigrate immediately by applying the old priority date to the new petition? Does it eligible to De Osorio v. Mayorkas (9th Cir. 2012)?
