If your case is employment based it seems unwise to apply for unemployment benefits.

Just my 2 cents, I am not a lawyer.
 
As of whether you are legit for the benefit, you ARE as long as you have an EAD.

The requirement for unemployment insurance is that:

"you were willing and READY to work at ANY time in the past week. "

If you have to file an H1B, that will be a question mark.

You are correct

H-1 holders are NOT eligible for unemployment benefits, when employment ceases, the H-1 holder must immediately leave the country.

Not if you have an EAD.

YOu can legally look for work and get the benefits theoretically with an EAD.
