I am working for a company A from last 10 years, now I am on EAD. My employer or company’s attorney will not ready to provide me copy of approved I140. I have crossed 180 days mark after receiving I140 approval; have copy of USCIS automated approval notice email. I am planning to take permanent (“same or similar") position in company X, Experts please help to answer couple of questions.
1. Do I need actual approved I140 copy while utilizing AC21 portability? (I do have copy of my labor certification and I140, I485 application copies). What are the consequences?
2. What are the chances to receive RFE after using AC21 portability? Which documents they might request?
3. I did heard some people received their I140 approval copy from USCIS using FOIA(G-639) form, not sure how long it would take, any idea? Is there any better process to obtain I140 approval copy?
4. Is it good idea to take help from attorney to request FOIA and while submitting AC21?
