Hi guys,

I am about to apply for my 485. Now I am afraid because most probably my project will be over by this month because of the budget problem. I am in dilemma of what to do. Whether to continue with 485 or do CP in India. What is the best option. Whether after applying 485 & before getting EAD and we lose the job any problem. Can we go to India for a 2 months vacation and come back? Please share your experience and thoughts.

My wife is in India now. She is coming back here next weekend

was your I-140 approved for CP? If not you will have to apply I-824 to ammend your I-140, which would take its own time.

If you have a valid H1 and if you employer does not terminate your H1, you can still maintain your H1 even after applying I485. You can visit as many times as you want on your H1.

If your H1 is expiring or if you use EAD, you would need AP to travel.

If you lose your job after applying I485 and assuming they terminate your H1, you will need EAD to work and AP to travel. But you will not be out of status.

My final advice, consult a good attorney !
