A very peculiar case of J1

Hi everyone, let me first explain the case:

I am a H1B physician. My wife first came to the US on a J1-research visa in 2008, then got a waiver. After that, she got a H1b research job for 3yrs. However, when she applied for residency, she was forced into taking a J1 again (the hospital had stopped offering H1Bs). Now that she is nearing completion of her residency, we've to take some big decisions regarding the J1 waiver.

Questions:
1. Does anyone know about the latest updates on GOI refusing to issue the NOC in India? Has anyone had a first-hand experience?
2. She had obtained a J1 waiver in 2008. Can she get it once again? (this time it will be under the conrad-30 or IGA)
3. In a hypothetical situation, once she gets this 2nd waiver, she'll be on H1B for 3yrs. Can she piggy-back on my green card application during this period? (I'm planning on applying through the EB1 or EB2 NIW).

This is a very peculiar case. I would really appreciate any inputs which you all may have!
