7thyear extension

7th year H1 with old I-140 possible ?

Is it possible to do 7th year H1 with a valid 2year old I-140
from a previous employer ?
 
can use 245I if labor not approved- for jim

if laboris not approved by the end of 6-year h1 is it possible to use benefit of 245I if labor is filed before april 31, 2001 or say august 15, 2001 if the new law is approved. jim your input will be appreciated.

any updates on nj labour..

hi, we applied our labour 2001 june , but seeing aLl these updates past 3 months , its not moving at all... does anyone have any idea why the labour is not moving at all.. or will it ever move..pl some body help.. i hate to be in CONFUSIONS...

Maybe. I posted this on the AILA website a few weeks ago. Basically, nobody has a definite answer. If all else fails, I\'d certainly give it a try.

You can still use 245i but remember, 245i does not waive all violations. Contrary to popular belief, 245i is not a blanket waiver that gives all illegal aliens an unlimited ticket to adjust.

A similar border case !!

Hi All..

I have 6 yrs expiring expiring in Aug 9th 2002

My company has filed for 5 1/2 months extension
for vacation taken outside US.

Now , my LC( received by Labor Authorities ) is Jan 14th 2002
so if i get back the vacation time out of US!

 a) if LC is pending for > 365 days ,(I140 not filed) i get 7th extension

 b) if LC is approved

In the very last line of the excerpt from Shusterman, you had quoted "The only requirement is that 365 days have passed since filing of the labor certification or immigrant visa petition"

I don't have a I-140 pending but my labor has been pending for over 365 days. My attorneys have filed for 7th year extension of H1. What is your opinion that I'll get the extension? Will INS require evidence of I-140 filing?

For Jim or Anyone knowledgeable:

as I had stated earlier, my labor has been pending for well over 365 days. Hence no I-140.
I'd like to understand the eligibility conditions to use 245I as "kuversa" had requested. Any help you cna provide in guiding me to some resource on this would be helpful.
Desperately, trying to cling on (as you can see) !!!!!

can I apply for change of status

Dear Jim,
I have been in H1B visa since 10/29/97
I got a job recently which is permanant
and the employer said they are willing
to apply for cahnge of status. I talked to
someone over faculty and scholars in our university and she told me I still can
file before the end of 2002.
I am currently stucked in Turkey because
of Technology alert and have been here since 17 may 2002, but my employer put me on extended leave of absence and
willing to wait for me.
Do I have enough time to apply.
Do I have to start right away.
what would be the difficulties regarding officals papreworks
like I-140 clearnce if I start the process

My other question is about applying for cahnge of status at the bord of entery,
what does it mean and how does it work
