485 Approved! Finally!

After a long long time pending on name check, my 485 case was finally
approved as per the email reply from CSC center.

History:

EB2- California Center
Labor PD: 09/2001
Labor approved: 01/2004
140/485 concurrently RD: 04/23/2004
name check starting from 05/10/2004
Finger print: 06/09/2004 (according to this, name check was
actually started earlier than finger print).
140 approved: 04/14/2005
2nd Finer print: 10/05/2005
On 12/28/2005, Sent mail to Senator for help on name check issues.
On 02/15/2006, got mail from Senator's office to inform me that
my name check has been cleared on 12/18/2005.
On 02/15/2006, sent email to CSC to ask for adjudicating my case
On 02/27/2006, got email form CSC to say adjudication will be done in
2 to 3 weeks.
On 02/28/2006, LUD updated with no message changed.
On 03/01/2006, today, email from CSC to say that my case has been
approved and the card will be mailed in 2 - 3 weeks.

Yes, name check is started soon after you file 485. There is nothing
related to finger print. These are two different things and are processed
by two different FBI departments.

I got reply from both FBI and Senator's office to tell me that my name
check application from CSC to FBI was on 05/10/2004, while I got the
1st fingerprint notice on 06/09/2004. This can tell you something.
 
thanks!I think now a days FBI don't respond to email enquiries...best way is to write senator after you become current and get the status response in reply!!!

Congratulations AprilCase. It is good to see the approval when the PD become current.

I dont know if it is true. In my case, the name check (06/2005) is started a year after I did my FP (05/18/04) that was 2 years after I filed my case(8/22/03).

It might be. Since your case (08/22/03) is not in the pilot program, your
case was not touched for long long time after you filed it. While my case
is different. It was in the pilot program window, when the case was filed,
the USCIS sent it for name check right away. I am sure at that time they
did try to adjudicate my application in 3 months. Unfortunately....it was
stucked at FBI since then on. My colleagues in the same time window with
me all get approved in less than 3 months.

I got approved on 2nd March...finally.

Now, I am waiting for the physical card.
My spouse's employer's attorney is filing for her visa extension, which expires on 9th March. They normally file just 3 days before the visa expires.

I wonder whether we should stop them from doing so now.

Will you post message if you get the card or approval notice in snail-mail ?

Congratulations!

I don't think you need to file the visa extension for her. When 485 is pending,
one is supposed to be legal to stay until the final decision is made. To apply
for visa extension is for the unexpected situation, e.g., 485 is denied, in this
case, she may remain in the states based on the visa. Now your application
is approved, the cards will be mailed to you soon and no more visa validity
check before you get the card. Why you should do it?

Well, just my point...better ask for attorney to make sure.

My I-485 case is very similar to yours. My PD is also 9/2001. All my inquiry to CSC and FBI returns with "FBI name check is pending".

Could you elaborate on how to get the help from the Senator? Or is the I-485 approval a direct result for the Senator's help?

Seems our cases are very similar. I did ask FBI for twice regarding the name
check issue and also wrote to USCIS for twice, but nothing help. And I
then wrote to Senator. The senator's office told me that they could not
push the FBI to clear the case as the security is very sensative but they
will do the help to send mail for inquiry. I then was notified that my name
check is cleared three weeks later. From their letter, I found that my name
check was cleared before I even sent mail to the senator. So the senator
didn't do a direct help on pushing the case but definitely let me know
in an early step so that I started to push USCIS right away.

I believe your case will get approved soon. Be patient and good luck.

Just one more question. After you wrote to the Senator, did the office staff contact you? Or you have to call them to follow up? How long does it take between you write to the Senator till the Senator's office find out your FBI name check status.

I wrote to the Senator 2 weeks ago, so far I didn't get any feedback. I am wondering whether I should just make a call.

After I sent mail to Senator, I never made any call and they didn't call me
at all. It took me 3 weeks to get the 1st mail reply (to let me know they
sent inquiry to FBI and let me wait) and another 3 weeks to get 2nd mail
reply to let me know the case was cleared. That's all.

You need to wait one or two more weeks. Normally they will give you an
update in one month unless they are really busy.
