140 RFE - ability to pay

Hi All.

I have got a query on my I140 on ability to pay issue. They are asking My Company's tax return from 2003 to till date and my w-2 from 2003.

I got paid the following wages and prevailing wage on the Labour is 65 K

Priority date is 2003 March and LC approved in Jan 2007
Nebraska service centre

60k+ in 2007
53k+ in 2006
35k+ in 2005
33k+ in 2004
33k+ in 2003...

The company have profits in all years except 2006 which year they bought another company and shown operating loss. But have significant assets.

And the comany has approximatly 90 employees.

What are my chances and how to respond to this RFE..Please help.
