140 delay for applications without original LC

Hi Guys,

I found out recently that my company filed my substitution case without original LC and USCIS is refusing to issue EAD/AP (even after 1 year) and won't do so until they "find the original file"

Does anybody know how long they take to "find the original file" and adjudicate cases filed without the original labor?

I got EAD/AP within a month after filing without original LC

My company had filed for one 140 application and subsequently withdrew it. They did not get back the original LC and filed my 140 with a copy of the labor sub and a copy of the withdrawal letter.

Though there has been no update on 140 (ND - April 08, 2004), I got EAD and AP within a month of applying for 485. I guess it depends on the adjudicator or they may have changed their policy recently.
