    Name Check

Write to the FBI stating the details of your case (give all information possible) and request information about the status of name check. The email ID is [FBINNCP@ic.fbi.gov] You should get a response after several weeks. Good luck!

    NIW Murthy

RFE's are pretty common. Many law firms do charge extra for the RFE response. This should be negotiated prior to signing up with them. When LOSM did my petition, they got 6-8 weeks of time to work on the petition AFTER receiving all letters of recommendation and other documents from me...

    EB1 and retrogression

No, it means that since you applied prior to the cut-off date (Sept. 30th I believe) your I-485 applicatoin was ACCEPTED and until VISA numbers are available you may continue to avail of EAD/AP renewals. Had you applied after Sep. 30 and if you are from one of the retrogressed countries, your...

NIW help needed NSC (degree related)

Go ahead and submit your Ph.D degree/letter by the RFE reply cut-off date. You get around 80 days to reply. So you should have your degree by then. Also, its too late to worry about the degree not being conferred by the application date. The adjudicator might even overlook that fact which in...

What will happen if we change job after filling for NIW(I140)

I'm not sure USCIS expects you be an indentured worker. However, if you've obtained non-physician NIW GC, its best to remain in that field (or at least be able to justify moving to another similar area) for perhaps 6 months after you receive your GC. If you're going to lose your job and...

What will happen if we change job after filling for NIW(I140)

I cannot comment on Nebraska center. My center was CSC. There are really no guarantees on the processing times but the most representative times are the 'current processing times' posted on the USCIS website. It does help to have letters from Federal agencies. Sometimes USCIS even...

    NIW or EA from overseas

In my opinion (please note the word *opinion*), EA is a better option for your friend than NIW. Also, there was a recent posting, by someone from overseas, on this message board about a successful application under the 'special Soviet scientist' category. Basically, both NIW and EA are...

    MBAs make strong NIW cases??

In brief the 3rd prong argument asks you (or your attorney) to explain that if the USCIS were to require you to undergo labour certification, the national interest would greatly suffer? This is the counter posed by the 3rd prong. This is what your attorney has to also address. In reality...

    MBAs make strong NIW cases??

One would have to define one's field in a pretty narrow fashion in order to qualify as *the best* in one's field. Check out the NYSDOT case. VSC's director clearly stated that labour certification is indeed meant to identify those individuals who cannot be substituted by US citizens and...

    MBAs make strong NIW cases??

Your lawyer probably scaled her normal fees in proportion to your salary :p . Those of us who dwell in university research labs paid slightly less than half as much for each stage and we went with fairly reputable law firms. The main difficulty with NIW is the third prong which requires you...

Attorney in San Francisco for NIW?

Unless you must really talk to the attorney in person, I see no reason to restrict your choices to the SF area only. I used The Law Office of Sheela Murthy with positive results. Rajiv Khanna (of this forum) is another excellent lawyer.

Sheela Murthy and Rajiv Khanna, are very professional. There are plenty of good attorneys.

Urgent Help Needed -- VSC NIW RFE Received

What is your RFE about? Depending upon that you can decide. You could choose to answer it yourself to the best of your ability and/or make use of the many DIY-RFE kits floating on the web. Some lawyers don't charge extra for creating the RFE response, some do. If you choose to answer it...

    NIW approved

You might want to consider contacting a congressional or senatorial liason and find out where it is stuck. Sometimes this can help track it down. Once a senator's or congressman(woman)'s office contacts USCIS they are bound to respond.

    NIW approved

The published dates are approximate. Don't believe them implicitly. USCIS does approve cases out of turn and even earlier depending upon the workload of the adjudicator or simply luck.

    Job change after 140 approval

While this may sound strange in light of accepted norms, I did receive an RFE in April 2004 for my NIW asking for evidence that my current job was in the intrinsic national interest. This was CSC.

H1-B is a dual-intent VISA. You cannot be denied the VISA if your ONLY *crime* is an immigration petition. Fill in the facts. You should be fine.
