    485 approved after filing Lawsuit

Amir, I re-read the Pro se handbook, I think you should file for "Motion for Default Judgment" if the defendant has failed to reply after 10 days. Default Judgment means the court to rule that you won the case. I think since this rule is a Federal rule, you should be able to use it, when you...

Here in Northern California, when I filed the case at that time they set up an Case Management Conference date, to start the Discovery and Hearing process. This would be the next step in the lawsuit. You will need to contact the judge's office for starting this. I'm surprised they did not give...

Too bad Iowa AUSA are not co-operative. AUSA has nothing to respond to now. Basically the judge does not want to dismiss the case. So if your 60 days are up, then there will be Case management hearings. I would strongly advise you to take Legal help at this time, OR you can research and...

    Approved

Congratulations Vic, I agree it is a lot of fun filing a WOM :D , but I tell ya it's a lot of blood, hardwork, tension, stress, etc. etc. But in the end when you hear AUSA saying "Your case is approved, Can you drop your lawsuit now?" its totally worth it. Enjoy your GC!

Thats good that the Judge denied Motion to dismiss. At least you did not get a judge who sides the government, I think there is a judge in Houston who is very baised. As vic said, the next thing would be a hearing, or if you are lucky AUSA will get off his/her ass and actually talk to USCIS...

Can Some one help on my 485(Sree).

Usually people file lawsuits because they are stuck in NC and they have exhausted all remedies (Congressmen/Senator/FBI emails), like me. In your case your NC is cleared, I would first advise you to do a Congressman inquiry, simultaneously start a Senator inquiry, and I have heard Mrs Laura...

Taha, I used these documents as my Templates. You will have to customize the WOM-sample to your case. When filing with the court you will have to file along with the Civil cover sheet and Summons. The summons should be given to - Michael Chertoff Secretary of the Department of Homeland...

rahman1079, Sorry for the late reply, I havent been checking this forum that often. Did AUSA call you? The judge will rule if the motion to deny is accepted or not, which by now he/she may have made. Can you give an update on what happened?

Anyone with a lawsuit against USCIS or thinking about a lawsuit (Merged)

Good and you will get your Oath letter.:) What I have learnt from my lawsuit dismissal was never dismiss the case unless you have proof in your hand that your "Prayer" of your complaint has been fulfilled. But I have seen many cases where AUSA is guaranteeing to adjudicate the case within a...

boston_case, I dont think you should sweat on this. But did you put "dismissal without prejudice" in your dismissal? If so you can re-open the case without starting the whole process over. But I just think its just a rude officer, with a bad hangover, or the spouse beat him up the night...

Sorry to hear about that. But don't loose hope. This is a tactic followed by some AUSA who are lazy and not ready to do their job. There are several cases in a forum where this has been done. Post your question there also -...

    KJ's thread

Is it 3K for the entire process? or just for filing? What if the lawsuit goes to court for Hearing, does this include those fees? If its the whole process (including hearing) then its a good deal. If its just for filing then definitely do it yourself. It sounds very intimidating to go ProSe...

This is bogus. They call the lawsuits "Loopholes". It's not like we are getting our cases resolved under the table or using a loophole. All the lawsuit does is put some fire below USCIS and ask FBI to expedite Name check. Its not like FBI gives false results back to USCIS. It is legitimate and...

I filed WOM from Northern California (San Jose district court) and ProSe. Looking at your signature, your RD is 1 day before mine, so I can understand your frustration. There is a thread on lawsuits (http://boards.immigrationportal.com/showthread.php?t=194681&page=1000 ), and there are some...

    KJ's thread

Congratulations KJ. Looking at 485 threads now, I get the feeling that FBI has started to clear the name check backlog. Do you think your NC cleared because of Sentor? Or finally FBI has stopped slacking and is getting some work done?

I think "Intent to sue" is a waste of time. Just skip it.

You most definitely have to wait till your PD is current or else the US Attorney will file for dismissing it. WOM is something you file when your case is ready for approval and you have done all you can to help resolve it, which means - * Senator/Congressman inquiry. * FOIPA inquiry. *...

I filed it Prose. My lawyer was charging me about $3000 for just filing + court filing fees ($350). And if it goes to court for hearing the lawyer would charge per hearing appearance fee. My thought was to file it myself without the lawyer and save $3000, and most of the cases I have followed...
