In phoenix, you can send a fax or letter to Sen. McCain's office to get status if you like. They're pretty fast at getting a response (few days). For your 140, you might be able to use the CSC emergency number if that still works. The employer and/or lawyer (if it's the same that did 140)...

I was also under the impression that the I-140 is even referred to as an immigrant visa petition. You would think that if the immigrant visa petition is approved, you would get an immigrant visa ;)

I got the same response when my attorney queried the USCIS about my situation. They said that they have an allocation of visas for pending interview cases. Which seems odd since I have heard many times before of people going to interviews, get conditional approval, not get passport stamping...

Just an FYI, my attorney contacted an immigration officer and they are also in the opinion that we should have visas reserved for us since our appointment is before July 1st. I hope for both you and I this is the case.

Thanks for the positive thoughts. I also wish you the best in getting your approval. Over the last year I have found that although it may be easier and less stressful to passively let things be as they may, more often than not it's better to be proactive and try all avenues to help things...

Unless they processed your case last week it doesn't matter. The visa availability only matters when they are trying to approve your case.

Some of the district offices are sitting somewhat idle and they have been using (abusing) the idea of transferring these cases from the service centers. It may show up as a backlog reduction effort ;) They have also been transferring EB cases to train district officers in processing EB cases...

Hi Janannwill, Maybe I'm just completely paranoid but I'm so fearful of missing out right now. As you probably know, the EB3 category is going "unavailable" as of July 1. My worry is that there's a distinct possibility that they may run out even before July 1st. Who knows what will happen...
