When you are flying on Air India out of Newark to Mumbai VIA Paris without changing Aircraft at paris in this situation you do not require transit visa Right

I filed concurrent I 140 and 485 petition based on a EB2 substitute labor I got AP and EAD but I 140 is not yet approved. I do not have valid H1B visa stamp. I have H1 B extension up to 2009 based on my original I-140 approved(EB3 labor) In case if the I 140 denied during my stay out side...

This may be possible .. But Based on what dates they will approve Cases as Visa dates are not avilable for any Category?!!!!!!!
