Well I'm exactly in the same boat... I had my H1 with compnay A while being sponsored for a greencard by a sister company B that belongs to same owner... Well, now that I got my greencard finally :D (3.5 long years!!!) I have to change employers to company B and neither myself or my boss wanna...
I see there's one question that keeps not being answered and that is what is the worst that can happen? delay in naturalization? loss of g/card? I guess nobody knows the answer, that's why it's being avoided. In my OPINION (and it's just an opinion) it all depends how severe a case USCIS wants...
I don't understand how her boss don't allow the "switch" to take place... As you mentioned, this is just a technical/formal switch between sister companies... she can probably continue to do the same job/tasks she was doing so far only under the "employment veil" of the company that sponsored...

Very interesting report to read... Also interesting - at the end of the table that breaks down each type of visa/application (on p.43) it says they may run checks not just on applicants but also on the employers/sponsors, where needed. I believe that is what the term "Domestic Investigation"...

GCs are being issued based on PDs so you should be good in Oct when new visa numbers will become available, provided the eb3 Cat doesn't retrogress for your country before July 18, 2002.
My I-140 was also surprisingly approved this week after bein pending since 09/2006... Security checks/ Background checks/ Name checks - isn't that something that EVERYONE has to undergo during the I-485 process, not I-140? I'm confused now.. :confused:
I don't think so at all... Background check or Name check is something that EVERYBODY has to go throu and indeed they are backed up on that significantly... Domestic Investigation is something that only "few" have the honors of having, and yeah - it's bad news af far as delays are concerned...
Can you port Priority Date from a previous I-140 when dealing with Different Employers?? Different EB category? Diff LC??
As for filing two I-485s - I'm following GINNU advice and filing my second one today... Lawyer says at most - they may ask you to choose - at a certain point - which one...
I mean if they process each application seperately (and I'm sure they're not intelligent enough to do it otherwise..) - why should one 485 interfere with the other??
