How do I know? Supposedly the USCIS responded to my lawyers on this matter and told them this. I did get an RFE for the original labor cert and my lawyers responded to them. Regarding the LUD, I really don't know as I've never checked that (I don't have my 140 WAC #). So does anyone here...

I am in the same boat as you buddy...I am also waiting and waiting and waiting...my I-140 ND was Aug 2003 (EB-3, Concurrent with I-485). Doesn't seem there is anything we can do..at least my AP and EAD got approved..

Thanks..I am not sure if an I-140 was filed for the previous petitioner..maybe thats something I can ask my HR dept. In the meanwhile..I guess its back to waiting and waiting and waiting...and then some more waiting. Ah well..at least my AP and EAD got approved.

You can however, get the interim EADs at the local INS office (at least I got mine without any hassles -- if you don't count lining up at 5am and missing half a day's work a hassle :) )

I also received an RFE on my I140 (EB2, concurrent filing) and my AP and EADs have also not been received (everything filed August 2003). My wife and I, however, received the interim EAD at the Chula Vista office in San Diego without any hassles.

Yes, as far as I know, the CIS has released guidelines indicating that AC21 is applicable only when I-140 has been approved. Check the breaking news sections in www.immigration-law.com and elsewhere for more info. I agree that this totally nullifies the advantages of AC21 given the slow rate...
