I got my green card a while back but I did not have my birth certificate at the time. So I used affidavits from my parents and my uncles as a supplement. Now that I want to file for GC for my parents, what can I use in lieu of the requirement of my birth certificate that shows my parent's names...
All,
I have my H1 approval and have an appointment with consulate in September. I have booked my wife's appt. as well for H4. Although, there is a seperate H1 in progress for her, the approval is not likely to come before our appointment (regular processing). My question is:
Can she...

Here is my situation:
- I left US about a year ago after completing my 6 years on H1
- I was told that I can work from India and I will be brought back to US on L1-A after one year
- I also checked repeatedly whether I need to be paid in India. To that end I was told that it does not...
Thanks Gopal.
My company has Blanket L1 but I have spent 6 years on H1 before I came back.
Does this present a scenario that they file the petition but I travel after one year completion which means I can avail no LC provision under L1A?
I have no problem waiting one year but the lag...
Is there any way to file a petition for L1A before the end of 1 year in foreign company along with a letter of intent that the travel will be after the completion of one year?
My attorney says no but I am not too sure.
Q
You have it down to an art!
Way to go man!
I am in the same boat although my petition is not filed yet. But I wanted to book the appt. too so as to save some time.
Q
Lana,
What I meant was that I could work out of US for 6 months. I have that option. My attorney tells me that if I do come back after 6 months, I cnnot file for I 140. Is that true?
I was hoping to file for I140 and 485 in that last one year.
7280,
I think you are right on the 365 day issue. WWW. immihelp.com states that you can use 6 month option but in that case you will have to go thru LC process under L1A. So it really does not help. I would rather stay out for 365 days and then apply and get faster processing for GC...
I had a same question to my paralegal but according to her and her attorney, it should not be a problem because they will be giving a declaration on that front. They argument is that the payrolls for most of the entities worldwide are being generated in US and this being one of them.
To that...
Do I need to have paystubs from the foreign entity for applying to L1 Visa category or can I continue to receive salary in US while working for foreign entity?
Q
I know it is an old post but if anyone is still getting updates.....
What if you come back on L1A under blanket L1 (if available) and apply for I140/485 at teh same time and get EAD. The process should take about 8-9 months as of now. Is that doable?
I am in the same boat. However, I am leaving for India next week and am trying to see if I can get back in 6 months based on blanket L1. Do you know if it is possible?
What is the difference between NON-RIR and RIR? According to what I understand, RIR required teh company to advertise for 6 months and non-RIR, DOL does it.
My question is, do they do it for 6 months? If so, then how are they different processes? In MA, non-rir is Nov 2003 and RIR is Apr...
Hey 7280....Any progress on your case.
Unfortunately, my attorney confirmed today that I have to be out for one full year :(
Do you guys have any other suggestions?
I have been working for a multinational company for the past two years on H1B. Unfortunately my GC process got stalled because my wife got laid off and it was her co. which was doing it. Not expecting this situation, I never filed LC from my co. As a result I am nearly done with my 6 years. My...
