Hi
My son is an US citizen who has unexpired PIO with the old US passport. Recently he got his new US passport . We have a upcoming travel plan to India and I have the below questions w.r.t to his PIO
1)Is PIO endorsement mandatory with the new US passport?
2)If the answer to the...
My son is a US citizen/passport holder and we are planning on applying for a PIO for him at the SFO consulate. I have the following questions on how he could use the PIO card
1. How can he use the PIO card to enter and exit India?
a. Does he simply show the PIO card, US passport to enter...
its depends on consulate to consulate basis. If everything goes fine and there is no additional checks done by the consulate then you will get your approved envelope within the max of 5 business days.
Thanks everyone. Could you please answer this alone?
1)If I decide to work on EAD will it affect my GC pending in AOS (AOS through my wife's I-485 with me as dependent) right now by any means at all in the future.
The 180 day window that I am talking about is the AC21 window whereby you are allowed to change jobs after applying for your I-485(and 180 days has passed) and your I-140 has been approved.. Does that have any role to play in the usuage of EAD at all?
For your convenience I repeat the...
I am currently on H1B and my I-140/I-485 has been applied. My I-140 hasn't been approved while my I-485 was applied with me as secondary applicant to my wife(who is the primary applicant). I recently got my EAD approved.
Under the above scenario:
1)Will I be allowed to work on EAD though...

You shoould submit PCC's for any other countries residence (if your residency is more than 1 year I believe. Hence for example if you had stayed in UK, Canada for more than 1 year you should provide PCC from UK, Canada). Also you should provide PCC for Indian residence. The PCC for India could...
i did the analysis and it is possible. There is no risk involved in it. Just make sure you have the experiences of EB2 before you join your current employment. however i was lucky that i got my GC before I started the second EB2 appln. :).
u have to check the visa bulletins to see when your PD becomes current. When your PD becomes current and if consulate receives your file from NVC then you will get it very soon. Typically the interview could happen anytime between 4 months to till the consulate is ready to interview you once NVC...
there is a form called I-765 or something(search these forums on this and you should find the form). That is the form that they use to switch from 485 to CP. depending on the consulate /uscis body it mgiht take 6-1 year there alone. then your CP if PD is current will take about 6 months. goodl luck.
If GC is granted, your H1B visa stamp would be cancelled and a new IV stamp would be placed on your passport. Until you enter into US from that stage you don't have any status w.r.t US. On entry you would be stamped on your passport with I-551 stamp which makes you a GC holder and that stamp is...
pkt 4 if the consulate does send is generally sent with the appointment letter. they ususally come a few weeks before appt and hence pkt 4 and appt letters are usually downloadable from their website.
you can do a follow-to-join . ask your husband to fill out the ds 230 forms and hand it out to consulate i believe. please check with the attorney or whoever is guiding you for the exact procedure. but certainly follow-to-join is possible in your case. However the interview would be scheduled...
