    Travel questions

Review this form - http://www.uscis.gov/files/form/i-130instr.pdf - under section "Who may not file Form I-130?", item #3 about stepparents. You can obtain a GC for your dad only. It looks like you won't be able to obtain a GC for your stepmother, because you can't file I-130 for her.

    Question on Visa Stamping

So long as you have an unexpired, multiple-entry H visa in your passport, you don't need a new H stamp. Yes, the I-94 departure date should be the expiration date of your H1B extension (Sept 2014).

over stayed visa now married to USC

If she can prove she has been in the country illegally for under 180 days, then everything is fine. - file for I-130 and I-485 and prove the marriage is genuine. The key thing is finding documentation to prove when she entered and how long she was illegal. If USCIS believes she has been in...

    Overlapping Two Year Residency Requirements

Sorry, not from personal experience - this is just how I read INA 212(e). Essentially each program has its own two-year residency requirement. Likewise, if you were to obtain a waiver, you'd need two waivers.

    H1B Transfer

If you want to use company A as your back up option, and prefer to work for company B, that is totally fine. Let both petitions go through USCIS and get approved. Then apply for visa with the petition that you prefer (company B, I suppose), and more importantly, enter the U.S. and show that same...

Travel to USA while I-130 is in process

It depends. I-130 shows immigrant intent. If the question comes up, they may turn her down at the border. But it's worth trying.

    I have both J1 and B2. Can I switch?

It will be a problem to the extent that you can't further file to change/extend your status once you get a denial. But you can depart (in fact, you have to depart) and obtain a visa outside the U.S. provided you can make a In case of rejection - yes, you have to leave immediately (few days).

    EB2 I140 RFE -- Experience -- Urgent please

Sure - this will help, but he/she will not be able to extend the H1B beyond the 6th year before the labor certification has been pending for 365 days.

    H1 Extention question,colse to complete 6th year..

Very important -- you can't work while you are on B status. You can try to get your current company to file to reinstate the H-1 status (basically to switch you back from B to H1 while you are still in the U.S.) But to do this three things need to happen: 1. they need to have documentation +...

L1B in RFE and H1B under regular processing

Take a look at this guide - http://www.uscis.gov/files/form/m-274.pdf Basically, you can continue working on your L1 status until the USCIS denies it, or no longer than 240 days from filing the extension, whichever comes first. If your employer doesn't reply to the RFE on time, USCIS will...

    I have both J1 and B2. Can I switch?

The simplest way to stay for 3 more months is to apply with USCIS, while in the country, for change of status to B1/B2. This can be approved, even though you are subject to the 2-year rule. Change of status to H1/L1 (work visas), or adjustment of status to permanent resident is not permitted...

Yes you can change from H to J1 status, if you are not currently out of status and have a DS2019. H1 Extention question, colse to complete 6th year..

If your I-94 says expiration ("departure date") Oct 18, then I would recommend you to contact the local port of entry http://www.cbp.gov/xp/cgov/toolbox/contacts/ports/ (ideally the one you entered the U.S. through), and ask them if you are permitted to remain in the country beyond Oct 18, and...
