The provisions for transfer of the earlier priority date are unrelated to AC21 portability. Having solely an approved I-140 petition (without an I-485 that has been pending for 180 days) does not give the individual eligibility for AC21 green card portability. We have received some questions...
Has anyone been approved with a salary of less than $60,000?
I see a question in the LCA that asks if the employee will make over 60,000 or has a masters degree, then they are "exempt" Does that mean for the cap?
thanks!
As of this month looks like there are 100 spots left, do you think it's a waste of time for me to try this year?
"As ofJuly 10, 2009, approximately 44,900 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will...
Does your 485 only become in "pending" status if you file after your PD becomes current?
What if I were to file ahead of the PD date, would it still be considered "pending" so that after 180 days I could change employers?

Please help me!
I don't see why I wouldn't be accepted for H1B into the job that my employer has filed a Labor Certification for, unless you aren't able to fill it until you get the greencard?
I hear you can only carry your I 140 if you have I 1485 filed 180 days correct? So I I would...
I'm on a TN under Management Consultant, I started PERM for a new position(but same employer), but since it will take 5 years for me to even file my I 485, I'd like to switch to the safer H1B.
Can I use the old LC to get a the H1b?
If so, and I get H1b, can I leave employers and still use...

But I should at least switch to H1 and then I could transfer employers right, and still use my I 140? I don't think they would...
Thanks nelsona,
Looks like I got some planning to do.... I'm thinking the best option is after 2 more years experience here, get an H1, dispute the prevailing wage this time so its not an issue, and start PERM over in EB2 but transfer my 1-140 PD.

No unfortunately just a college diploma (film school)
So I'm on a TN as management consultant. My PERM is for a new position, Producer.
But if I were to change to H1, I can't use the same LC/1-140 because the skills asked for was only 2 years exp. + no educ...
I feel like I am stuck, I have a 3 year diploma and 8 years experience. I'd like to transfer, to H1, but I don't know if I meet this requirement?
C. "Evidence of education and experience that is equivalent to the required U.S. degree"
Eb2 wants 10 years experience with diploma.
