my situatuation:
Applied for H1 tranfer but got deniel Notice stating employer-employee relationship (year 2010) but i have to stayed for abt 6-7 months as my wife has pregnency complicaton(have dr. letter )then I returned back (my I-94 was valid).
I am out of USA since 2.6...

Hi,
I am out of status as my H1b has been denied. I have couple of question.
1) Can I apply for Asylum or should my spouse should apply for Asylum.
What complication could occur ? Do any of you have any idea.. Help is really appreciated.

You DO NOT have any status at this time to stay in US. New employer Cant file for a person who is out of status and staying illegaly in US. Go out................

------------------all depends on LCA filed by employer and duration of H1 asked in petition and start date. you can join once get H1 approval and get H1 visa to come back to US. you must talk to new company lawyer and clear your questions. Leave US so that employer can file Fresh H1 for you...

If my employer file for Fresh H1B in Premium Process and Meanwhile I leave USA and we get H1B approval. Do I have to wait till Oct to return back to US or I can join my employer as soon as H1 is...
I don't know what are my options, Please help me,
-------Go out of US and let B file Fresh H1 for you , once your H1 gets approved then get H1 visa stamp and come to US if B has job for you. I dont see any other option for your situation.
