Yep I was wrong spouse's H1 visa will expire one month after he returns. I thought at first, you can't leave US if your H1 will expire within 6mos. Thanks so much for the replies.

Your situation is the same what happened to my friend..the good thing is it won't be affected..you already have your AP and EAD...in her case her 485 just went through even if her previous employer closed. Hope this help you a bit.

I think you just need your AP and EAD when you re-enter US. No need to stamp your passport.
