    AoS or CP

The response in the last post doesn't align with the questions asked...too generic and elementary.

    AoS or CP

Thanks for the response. 1a. Re # 1, In case I don't go with concurrent filing, at what stage do I make a choice whether to go the CP or the AoS route (provided the criteria of beneficiary's location is met at the time especially for AoS)? Does USCIS ask for the choice after I130 is approved...

    AoS or CP

I am going through the requirements of filing I130 for my parents. There are a couple of queries I'm not sure I have answers to, so would like to get some advice on: 1. Can AoS (I485) be filed for parents (concurrently or after getting I130 approved) if they are in the US on a B2 (visitor)...

I did go through the threads on the portal but couldn't find answers to my specific situation. Hence, posting them in a new thread. Appreciate responses. 1. I...

    Frequent address changes post GC

Guys, I am entering 5th year of GC and lately have been forced to change my address frequently (in 1 month gaps) by circumstances. I have been filing AR11 online as I change address. Would the frequent changes in address cause any issues at the time of applying for citizenship. I do expect...

After 5 yrs on H1, moving to H4

Gurus, Need some advice on a situation. I have an acquaintance who has completed 5 yrs on H1B and would move to H4 soon. I understand H4 status is linked to H1B primary being in-status thereafter but is there a time limit for H4 as well like its 6 yrs (excluding any LPR related extensions) for...

    Univ. work towards work exp.

Yes. I thought so too. Good to see similar opinion. Agree that it would be good to keep it simple and put it as MS+2yrs work exp w/ salary now meeting market rate. Thanks for the inputs.

    Univ. work towards work exp.

Sorry, should have been more descriptive. Its for an acquaintance. Here are the details: EB2 application: MS + 2 yrs work exp (2 yrs work exp with a prior employer in the same field after MS) First PERM with current employer was rejected, so the employer reacted by increasing the salary. But...

    Will I receive a NOID?

Yes H1B revocation does not automaticaly trigger I140 review within USCIS. So, its not necessary that you'd get an RFE. It all depends upon how early does your AOS file get looked at after H1B revocation and which also depends upon where you are in AOS phase like whether PD is current or if...

Continue GC process while outside US

Bear in mind that if you choose to do so, and apply for AP renewal by visiting the US, you should not leave the country unless AP is approved (even though you have a valid prior AP or H1B) else the AP application would be deemed abandoned and would be denied. No such restriction for EAD renewal...

What evidence is required to bona fide married status?

Send joint tax returns for as long as you've been married. Also, you could send marriage pics, affidavits from parents and any other supporting doc that shows you two to be married. Don't fret. The difference in address is what that's triggered RFE, send some "secondary and tertiary evidence"...

PD current next month and Finger print already expired

The intent was to advice the OP not to fret if there hasn't been any re-finger printing though its always better to do a case specific inquiry with CIS (call them or schedule infopass).

PD current next month and Finger print already expired

I have heard of an instance as recent as this month where I485 was approved without any re-finger printing after the initial one done when I485 was applied for (around the 2007 fiasco time).

    I485 questions after EB1A I140 approved.

If she currently doesn't have work authorization or wishes to work on EAD once 485 is filed, then yes. Its not a requirement to file for EAD along with I485 application. It can always be applied for later once I485 has been submitted.

    deadline on I-485

File before the last date of the month for which the visa bulletin shows the PD to be current. And if you haven't filed until the next month's bulletin is out and it shows that the PD continues to be current for next month, you'd have additional month time to file.
