What if my criminal check doesn't come back in time for my interview?

A person on another forum just had her interview and she didn't have all her background checks (the one she was missing was from when she spent time over in another country). Her interview was successful, however the visa will not be approved until she receives the background check and forwards...

    K1 and documents

Hmmmm- as far as I was aware the k3 had been administratively closed- though the cr1 would require an I-130 approval whereas the k3 needs both i130 and i129f- so it 'looks' as though you have a petition approved for a k3. I guess youll have to wait until you hear from the consulate, unless of...

    K1 and documents

ALL signatures MUST be originals so they cannot be sent electronically. She must sign them and then mail them to you. The photos must be originals also. When I had my interview I had my fiancées original copy of his birth certificate as proof of his citizenship, so I believe your fiancee will...

    Arranged marriage and k1 visa

If they want to pursue the K1 visa then they will have to meet in person and have proof that they have (passport stamps/airline boarding passes to one another's country that are dated). It is a requirement for the K1 that they have at least physically met each once in the past 2 years.

    Arranged marriage and k1 visa

Have the 2 people in question physically met one another at least once in the past 2 years? If not- does their religion specifically not allow the bride to meet her groom until the wedding? If they get married, then they will no longer be eligible to apply for the K1 and instead will need to...

    marriage before K visa?

You are wrong. CR1 and K3s are taking roughly the same amount of time. The added bonus with the CR1 is that it is overall cheaper and the wait for permanent residency (and the right to work in the US) is quicker.

    marriage before K visa?

If you go over there and marry her, you will then be able to apply for a spousal Cr1 visa. This will make her a permanent resident as soon as she enters the us with the visa in hand......the length of time from application to getting the passport back with the visa (when she's able to enter the...

    K1, K3 or Spouse visa

Why would you start the K1 process only to cancel it when you marry and start a spousal visa process????? That will just waste time. Once you get married while you have a K1 pending, the K1 will become voided and you'll be starting the spousal visa from scratch. If you want the quickest...

getting married, fiance has vistor visa already

I also forgot to add that once you get your passport delivered with the visa inside it, you should be good to travel immediately on it.

getting married, fiance has vistor visa already

No problem. I'm happy to help all I can. For the CR1/IR1 visa is taking on average (from the service center recieving the petition to the embassy interview approval) is 282 days. http://www.visajourney.com/content/ir1cr1historical. (the very last graph on the bottom of this page shows the...

getting married, fiance has vistor visa already

Sounds like a great letter. After further research on this issues, if NVC receives both the i129 and i130 at the same time then they will just process the i130 on it's own (administratively closing the i129) and the petition will follow the course of a CR1/IR1 petition. I still havent found any...

getting married, fiance has vistor visa already

Your lawyer is very misinformed. I would ask her on what basis does she quote 3 months. 3 months possibly for the approval of the initial petition, but this does not factor in for the petition to get sent to the embassy, the embassy to arrange the interview, medicals, the interview to take place...

    K1, K3 or Spouse visa

In terms of speed, on average the K1 visa is the quickest. In terms of what is the best visa, I personally like the CR1/IR1 spousal visa as your then spouse will automatically become a permanent resident upon entr to the US and not have to go through AOS.

K3, I-129 AND I-130 in process, any idea of time frame? my wife is pregnant!!

Can't really think of any others, unless you just shorten your visit so you can return to work before you compete the visa process. You may rock up to immigration and not even be asked a single question and just waved on through.....or you could be inspected by an immigration officer who did not...

getting married, fiance has vistor visa already

Usually around 8-12 months. Just a thought though, I don't know what the official call on it is now since I'm not hugely up to date with spousal visas (I came over on a fiancé visa), BUT there was talk a while back about completely scrapping K3s in favor of the CR1/IR1 spousal visa. With the...

K3, I-129 AND I-130 in process, any idea of time frame? my wife is pregnant!!

Stuff that shows you have ties back in England that you need to return to......ie, a letter from your employer stating when you're due back at work, mortgage papers, house rental agreement etc.

getting married, fiance has vistor visa already

No. The visitor visa is not voided. She could enter the US, apply for AOS, leave and reenter on B2, however this would still cause the AOS to be abandoned as AP is needed to keep it alive if you leave the country.

K3, I-129 AND I-130 in process, any idea of time frame? my wife is pregnant!!

If you don't have the spousl visa in time, then yes you can definitely attempt to enter the US using the VWP. Of course, like with any visit, there is no guarantee that you will get in so be mentally prepared for a refusal of entry, though many people do visit the US during a fiancé or spousal...

getting married, fiance has vistor visa already

She absolutely will need AP if she wants to leave the US (and get back in) during the AOS process. Once the AOS packet is submitted her status becomes 'AOS pending' (or something along those lines), and she won't be entering on the visitor visa as she wil be entering on her K1. To preserve the...

getting married, fiance has vistor visa already

When you marry and submit the aos packet, you can also submit an application for a Employment Authorization Document (EAD). This usually takes between 60-90 days to be received after sending off the packet. This allows you to work while aos is pending so there will be a period of time where your...
