My H-1B visa expired 12/2004.I had subsequently travelled to India using my Advance Parole. Now I have renewed my H-1B for another 3 years. Will there be a problem in getting a visa stamped in India because my previous visa has expired for more than 12 months.
I was told by my lawyer that I-485 approval is based on receipt date.My case is NIW India with receipt date of 2/05.My paperwork reached CIS (Fed-ex confirmation) on 6/11/07.I did not get any approval notice.
Murthy.com website indicates that the Oct visa bulletin is going to look more like April/May Visa Bulletin at best.So no hopes for several years for EB-2 India.
