Question about sponsoring parents who are illegaly in the US

please stop giving bad advise. the poster has stated that her parents overstayed their tourist visas. they would be subject to an automatic 10 year ban. that is an issue. your parents were subject to a 10 year ban the minute they overstayed a year past the date stamped on their i-94...

US citizen parents sponsoring over 21 son..

ok, that changes things. I'm not familiar with the details of the DORA program (there are posts here that detail it better) that covers the dallas area, but I believe that you have an immediate interview the day you turn in your packet.

    My brother needs help!!!

yes, absolutely. one can have multiple petitions filed on their behalf. at the very least you should have both of your parents file for him as in the event of death a case cannot be transfered from a deceased parent to the surviving one.

    My brother needs help!!!

he should go back home to ecuador and wait for his PD to become current after his parents and you file an I-130. which could take up to 10 years. unless currently there is something similar in the law like the 245(i) he cannot overstay his tourist visa.

Would a F2B case upgraded to F1 automatically when the petitioner becomes a citizen?

my attorney submitted my upgrade request with my AOS packet. my I-130 hadn't been approved at the time of the upgrade/aos filing. turns out it was missing from my file, and I had to fill out a new one at the interview.

    Father/Son relationship

do not assume that he doesn't have to go because the letter doesn't state it. if he isn't required to be present, fine he waits for you in the waiting area. if you show up without him and the IO has to cancel the interview you are going to be screwed and complicate the process. you may not...

    Father/Son relationship

I'm an adult and my interview notice stated that my petitioner had to be present (father). good thing he was there because they had lost my I-130 and we had to fill a new one out at the IO's desk. don't take any chances, take your parent with you.

    Father/Son relationship

they just ask for the birth certificate to prove the relationship. as far as the question, it is very simple. they ask you all of the "no" questions that you've previously answered on the AOS packet: - are you married? - have you been deported? - are you a communist? - have you ever...

how does the custom officer know how long you've been away?

when you purchase an international travel ticket the airline asks you to submit your passport number. the departure date is logged on a database. when you return to the u.s. and the officer punches in your passport number, guess what? he sees when you left and how long you've been away.

    anyone approved under 245i

yes, your petitioner must accompany you. the letter lists all the documentation you must bring, but bring everything. at my interview we were informed that my i-130 had gone missing. we produced a copy of the original and, of course, the NOA for it. it wasn't necessary as I had to fill a...
