EB2 NIW 5 waiver years in 2 locations

As far as I know, residency years in an underserved area do not count towards the 5 year EB2 NIW requirement, but in general the 5 years can be fulfilled in multiple locations but you may have to file multiple 140s for each location.

    J1 waiver, using AP

I got EAD/AP through Physician Underserved Area NIW. In fact this NIW is the only condition in which you can apply I-485 during the 3 year waiver period. You cannot send in 485 based on any other application. I was born in a non-retrogressed country and therefore I could send in the 485/131/765...

    J1 waiver, using AP

Yes, you can use AP. I started using AP from my 1st year of waiver while visiting India, am in the same situation as you, am still on H1B, never used EAD, ending J1waiver in 3 months...

    Hadron & others, your opinion

As I understand it, once you finish your NIW 5 year tenure and submit evidence to that effect, you are free to get your NIW 485 adjusted. One can stop working if so desired. I don't think you have to worry about future work situations impacting this NIW 485 adjustment.

Primary J1 waiver should not use EAD until 3 years are up, is this still true?

NIW 140s are taking about a year currently, however you do not need to wait for that to apply 485,131,765. You can file 485 and based on that 131, etc once your visa number is current (C). Physician NIWs are EB2 category and therefore you have to look at the state dept monthly visa bulletin to...

Primary J1 waiver should not use EAD until 3 years are up, is this still true?

You may be mistaken in presuming that EAD is also a travel document....it is only for employment authorizarion. For travel you need AP (Advance parole) which you get by filing I-131. In order to file AP, once you file NIW (I-140), you should be able to file I-485 (if visa numbers available for...

Canada vs Mexico? where to go for visa stamp?

Do you need to travel for which you need the visa stamp? If so then why don't you check out the US embassy in the country you are visiting? In case you do not need to leave the US, then the J1 visa stamp should not be an urgency, you need valid status to stay in the Us, the date on the stamp...

How long does it take for the case to appear online?

Most cases are in the system online in 3-4 weeks, so check with your lawyer. If he applied online and sent in the rest of the stuff later, he should have the case number already.

    Eb2niw

There is a good thread to start from: http://www.immigrationportal.com/showthread.php?t=97085 To start with - you need a NIW support letter from either the state health dept/ VA, etc and either a 5 year contract/ 3 year contract + practice plan. Its all fairly straightforward.

Recent Experience from J-1 to Green card.

Congratulations! I assume you went through CP based on the Labor certified I-140, am I right? It's also interesting that you used AP while on H1B secondary to J1 waiver as a lot of people say that one shouldn't use EAD or AP (NIW based) during the initial 3 year period. Can I ask for details in...

    Eb2niw

Just applied for NIW EB2 (physician) based 140 and 485s for me and spouse to Texas Service Center, applications arrived on 10/15/07 and checks already cashed on 10/19/07. Sounds kind of quick to me by USCIS standards, but OK with me ! Any correlation that the 140/765 (EAD) will be approved soon...

With EAD, you are free to work or not work as you wish. Can I ask when the application for EAD was made?

    J1 waiver - Conrad

Thanks for both your inputs, Hadron and Psychmd !! Just heard that my HIB (Premium processing) with COS was approved today by USCIS(within 7 days of I-129 application). Starting work soon... Incidently no receipt from USCIS regarding J1 waiver yet, but am assuming it has been approved...

Urgent - Plz Help me J-1 waiver with TWO Case Numbers

I believe only one case number is supposed to be assigned to a person - even if one needs an advisory opinion first and then a waiver eventually. You should call DOS at their number 202 663 1225, press 1 and then 0 and talk to a representative to try and combine both case numbers.

Processing times according to the type of J1 waiver.

Lagran77, sounds like you are also a J1 physician (same as me!). have you applied for your H1B yet? Let's compare notes..

    Address change advice

Looking for advice from folks Going through the Conrad J1 waiver to H1B process right now. Received favorable recommendation from DOS (including copy of letter they sent to USCIS), applied for H1B (PP) with it. Hopefully both USCIS J1 waiver and H1B will be approved soon. I did the J1...
