    N-400 What Form To Use For Child?

    Since section 301(g) does not state that the citizen parent should have spent five years in the US as a citizen, I think it is safe to infer that the parent could have been a non-citizen for at least a portion of that time period.

    Yippee! My daugher got her N-600 letter today - exactly 1 year after we applied!

    While technically it is an interview, in reality it is merely a formality. The USCIS wants to ensure one last time that things are in order. Yes, I think so. Although the USCIS is usually infallible (I am trying very hard to keep a straight face), they may have made a mistake here by...

    Time Frame To Apply Citizenship after marriage?

    Absolutely. While the CIS will not approve the naturalization application until the conditions have been successfully removed, this in and of itself is no reason to delay applying for naturalization.

    N-600 or N-400? What do I file to obtain citizenship.

    After a lot of googling, I came across the following site: http://www.ptla.org/immigrants/english/citizenship.htm The section on "Derivative Citizenship" clearly explains what exactly changed as a result off the CCA. I have included this section and highlighted in red the part that applies...

    N-600 or N-400? What do I file to obtain citizenship.

    Boatbod, I agree that if the OP were already a citizen prior to CCA coming into effect that he/she wouldn't be affected by this act. I am just not sure that he/she did indeed become a citizen, automatically, when his/her parents naturalized.

    OCI = Dual citizenship?

    The term "overseas citizen" is much more appealing than "overseas resident." On a more serious note, I believe that there was enough support for full-citizenship but along the way the program got derailed because of "security concerns." OCI was the compromise. Had the PIO scheme been a success...

    N-600 or N-400? What do I file to obtain citizenship.

    Refer to #7 in http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=1fb596981298d010VgnVCM10000048f3d6a1RCRD&vgnextchannel=d6f4194d3e88d010VgnVCM10000048f3d6a1RCRD that I have included below: The above statement jibes with my own reading of the CCA.

    OCI = Dual citizenship?

    The Indian Government wants to make OCI sound as attractive as possible and so it is hardly surprising that they do not describe it the way the State Department does! :D For Federal Government employees such as yourself, the only thing that matter is how the US Government views OCI.

    Name Included in Petition but...

    While the spouse and minor children of the primary beneficiary can immigrate along with the primary beneficiary when the US citizen sponsor is the beneficiary's sibling, the rules are quite different when the beneficiary is the parent (immediate relative) of the sponsor. In this scenario, minor...

    Name Included in Petition but...

    Since you are over 21, I believe you are no longer eligible (check with a lawyer on this one). Your father and mother are eligible. Either one of them can sponsor you as soon as he/she becomes a permanent resident provided you are unmarried and remain so until you become a permanent resident. If...

    Yes but you will be unable to naturalize until your I-751 is approved. http://immigration.about.com/library/weekly/aa102599.htm

    citizenship questions: urgent!

    As boatbod has observed, "You become eligible 5yrs-90days from the day you returned from your long trip." The other option, which I wouldn't recommend, is applying now under the 5-year rule and hoping that you can convince the CIS that your 7-month trip outside the US didn't really disrupt...

    Can a visiting parent get GC with Citizenship interview??

    I am not recommending that she overstay in order to file I-485. I am merely stating that if she files for adjustment of status while her current status is still valid then she can stay in the US indefinitely until her case is adjudicated. This is a very real issue. My friend's parents were...

    citizenship questions: urgent!

    According to Sec. 316.5 (Residence in the United States) of the Immigration and Nationality Act, only someone who has stayed outside the US for more than a year can, after returning to the US to resume permanent residence, apply 4 years and 1 day after his/her return. I don't believe you qualify.

    Can a visiting parent get GC with Citizenship interview??

    If forms I-130 and I-485 are concurrently filed while onehourrunner's mother is on valid non-immigrant status, onehourrunner's mother can stay in the US until her case is adjudicated. As an immediate relative of a US citizen, she is more or less guaranteed to get her green card. Is she prepared...
